1. Overview
This website (the “Site”) is operated by EE Botanicals (“EE Botanicals,” “we,” “us,” “our”). By visiting the Site and/or purchasing from us, you engage in our “Service” and agree to be bound by these Terms of Service (“Terms”). These Terms apply to all users of the Site, including without limitation browsers, vendors, customers, and contributors of content. We may update these Terms at any time by posting changes on this page. Your continued use of the Site following changes constitutes acceptance. 
2. General Conditions
We may refuse service to anyone, for any lawful reason, at any time. You agree not to reproduce, duplicate, copy, sell, resell, or exploit any portion of the Service without our express written permission. Credit-card data, if used, is encrypted during transfer; non-payment content may be transmitted unencrypted over networks and adapted to technical requirements. 
3. Product Use & General Disclaimer
Our products are not intended to diagnose, treat, cure, or prevent any disease. No statements on the Site or labels have been evaluated by the FDA or FTC. By purchasing, you acknowledge these disclaimers. Some products may expose you to chemicals (e.g., nickel, arsenic, lead) known to the State of California to cause cancer and reproductive harm (see www.P65Warnings.ca.gov/product). 
4. Kratom Product Disclaimer & Safety
• Not for use by individuals under 21, pregnant or nursing persons, or where prohibited by law.
• Potential risks include dependency and withdrawal-like symptoms.
• Public-health authorities have associated kratom use (short- or long-term) with possible adverse reactions including, but not limited to, agitation, confusion, nausea, vomiting, constipation, drowsiness, liver toxicity, tachycardia, hypertension, respiratory depression, seizures, and, in rare cases, death. Seek medical attention for adverse events.
• No medical advice: Content is for informational purposes only and not a substitute for professional care. You accept full responsibility for your use or misuse of our products. 
Legal Compliance & Age Verification. By buying from EE Botanicals, you certify you are at least 21 and legally permitted to purchase and possess kratom in your jurisdiction. You are responsible for compliance with your local laws. We will not ship to jurisdictions in which kratom is banned or restricted. Orders placed to restricted locations will be canceled.
5. Online Store Terms
You may not use our products for illegal or unauthorized purposes or violate any laws in your jurisdiction through your use of the Service. Breach of these Terms may result in immediate termination of access. 
6. Intellectual Property
All Site content (text, graphics, logos, images, downloads, compilations, software) is owned by EE Botanicals or its licensors and protected by U.S. and international laws. You receive a limited, non-exclusive, non-transferable license for personal, non-commercial use of the Site. Automated scraping, reverse engineering, or other prohibited uses are not allowed. Our trademarks, trade dress, and brand elements may not be used without our prior written consent. 
7. User Content (Comments, Reviews, Submissions)
If you submit ideas, suggestions, reviews, or other materials (“Comments”), you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, edit, publish, translate, and distribute such Comments in any medium. We are not responsible for user-generated content and may remove it at our discretion. 
8. Privacy
Your submission of personal information through the store is governed by our Privacy Policy (posted separately on the Site). 
9. Prohibited Uses
In addition to other prohibitions described herein, you may not use the Site: (a) for unlawful purposes; (b) to solicit unlawful acts; (c) to violate applicable laws or regulations; (d) to infringe intellectual-property rights; (e) to harass, abuse, defame, or discriminate; (f) to upload malicious code; (g) to collect personal information of others without consent; (h) to spam or phish; or (i) to interfere with security features. 
10. Prices; Modifications to Service
Prices are subject to change without notice. We may modify or discontinue the Service (or any part thereof) without notice. We are not liable to you or third parties for any modification, price change, suspension, or discontinuance. 
11. Orders; Billing & Account Information
We may refuse any order and limit or cancel quantities per person, household, or order. Restrictions may include orders using the same account, card, billing, or shipping address. If we change or cancel an order, we may attempt to notify you via the contact data provided. Provide current, accurate information and promptly update your account details so we can complete transactions and contact you as needed. Third-party payment processors handle payments; disputes related to their services must be resolved with those providers. See our Refund & Returns Policy for additional details. 
12. Indemnification
You agree to indemnify and hold harmless EE Botanicals, its affiliates, officers, directors, agents, contractors, licensors, service providers, suppliers, and employees from any claim or demand (including reasonable attorneys’ fees) arising out of your breach of these Terms or violation of any law or third-party right. 
13. Severability
If any provision of these Terms is unlawful, void, or unenforceable, that provision shall be enforced to the maximum extent permitted, and the remainder shall remain in effect. 
14. Third-Party Links & Tools
We may provide access to third-party content, tools, or websites “as-is” and “as-available” without warranties or endorsements. Your use of third-party tools is at your own risk and subject to the third party’s terms. 
15. Termination
These Terms remain effective unless terminated by either party. If we believe you have breached any term, we may terminate the agreement and deny access to the Service without notice. 
16. Disclaimers; Limitation of Liability
We do not guarantee that the Service will be uninterrupted, timely, secure, or error-free, or that results will be accurate or reliable. The Service and all products are provided “as is” and “as available,” without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
To the maximum extent permitted by law, EE Botanicals and its suppliers shall not be liable for indirect, incidental, special, punitive, or consequential damages (including lost profits, revenue, savings, data, or replacement costs) arising from your use of the Site or products. We are not responsible for delays or failures caused by events beyond our reasonable control (e.g., natural disasters, labor disputes, cyberattacks, supply chain disruptions, or regulatory changes). 
17. Dispute Resolution — Mandatory Arbitration & Class-Action Waiver
PLEASE READ CAREFULLY. Except for claims properly filed in small-claims court, any dispute, claim, or controversy arising out of or relating to your purchase or use of our products, the Site, or these Terms will be resolved exclusively by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The Federal Arbitration Act governs this arbitration agreement.
• Venue & Rules. Unless the parties agree otherwise, the arbitration will occur in Sacramento County, California (or by remote appearance where permitted) before a single arbitrator under the AAA Consumer Arbitration Rules.
• Relief. The arbitrator may award individual relief available in court (injunctive or declaratory relief and attorneys’ fees where authorized by law) but may not award punitive or non-compensatory damages.
• No Class Actions. You and EE Botanicals agree to waive any right to participate in a class, collective, or representative action. Claims must be brought in an individual capacity only.
• Informal Resolution First. Before filing arbitration, the party seeking relief must send a written notice describing the dispute and the requested relief to the other party and allow 60 days to attempt informal resolution in good faith.
• Severability. If a court finds the class-action waiver unenforceable, this arbitration clause is void and disputes shall be litigated in the state or federal courts located in Sacramento County, California. 
18. Governing Law & Jurisdiction
These Terms are governed by the laws of the State of California, without regard to conflict-of-laws principles. For disputes not subject to arbitration, you consent to exclusive jurisdiction in the state and federal courts of Sacramento County, California. 
19. Accessibility
EE Botanicals aims to provide an accessible website experience. If you encounter accessibility barriers, please email support@eebotanicals.com with (i) a description of the issue, (ii) the page URL, and (iii) any assistive technology used. We will respond within five (5) business days. 
20. Entire Agreement
These Terms and any policies posted on the Site constitute the entire agreement between you and EE Botanicals regarding the Service, superseding any prior agreements.

You can review the current version of the Terms on this page. Material updates will be communicated on the Site and/or via email. Continued use after changes means you accept the revised Terms.
